Deputy Chief Counsel For Litigation Named

FDA Chief Counsel Margaret Jane Porter has announced the appointment of Eric M. Blumberg as Deputy Chief Counsel for Litigation in the agency's Office of the General Counsel. Mr. Blumberg will assist the agency in its rapidly expanding enforcement initiatives by supervising FDA attorneys who conduct litigation. A graduate of Georgetown University Law School in 1969 and a member of the District of Columbia Bar since 1969, Mr. Blumberg joined FDA's Office of
the General Counsel in 1970 and has played a substantial role in litigating many important trial and appeal cases on the agency's behalf.  Milestone cases in which Mr. Blumberg was involved include the first instance in which FDA prosecuted a pharmaceutical company or individual for failing to report  adverse drug reactions; a case in which seven persons were either convicted or pled guilty to felony violations arising out of conspiracies to distribute counterfeit birth control pills; and a case in which a court declined to grant a petition to a firm seeking to compel the agency to act on its applications for approval to market drug products.
